Scope Of These Terms
These terms apply to the Nadopolo.com website, Polar Bear Plunge, club practices, clinics, camps, lessons, events, donations, and related communications offered by or through Coronado Aquatics Club, Nado Polo, Jesse Smith, coaches, staff, volunteers, and affiliated service providers.
By using this site, registering, donating, purchasing, or participating, you agree to these terms. If you register on behalf of a minor, you represent that you are the parent or legal guardian and agree to these terms for yourself and the participant.
General Disclaimer And Assumption Of Risk
Water polo, swimming, training, and youth athletic events involve inherent risks. By registering or participating, you acknowledge and voluntarily accept known and unknown risks associated with aquatic, athletic, travel, facility, and event-related activity, including risks arising from contact, impact, exertion, equipment, weather, pool conditions, or mistakes by participants, staff, coaches, volunteers, officials, facility operators, or other third parties.
Activity And Facility Risks
Risks may include, without limitation:
Water Polo And Aquatic Risks
- Physical contact, collisions, accidental impacts, and ball or goal-related injuries.
- Drowning, distress, near-drowning, fatigue, cramping, or panic in the water.
- Cold water, slippery decks, submerged hazards, lane lines, walls, and pool-entry hazards.
- Sprains, strains, fractures, concussions, cuts, illness, dehydration, heat-related issues, and other injuries.
Facility And Event Risks
- Wet surfaces, uneven walkways, crowded decks, limited visibility, and facility-related hazards.
- Weather exposure, sun, wind, lightning, poor air quality, or sudden schedule changes.
- Travel to and from activities, parking areas, loading zones, and public-access event environments.
- Behavior by other athletes, spectators, volunteers, or members of the public.
Registration, Eligibility, And Division Placement
Registration information must be complete and accurate. Coronado Aquatics Club may verify age, participant identity, emergency contacts, and other registration details as needed.
For events such as Polar Bear Plunge, division placement may be determined by age, experience, safety considerations, roster balance, and event operations. Coronado Aquatics Club may combine, split, reassign, or adjust divisions, schedules, heats, game formats, or participation structure in its discretion to operate safely and effectively.
Practices, Events, Schedules, Locations, And Staffing
Practice days, event dates, start times, pools, locations, coaches, staffing assignments, training plans, and age-group structures are not guaranteed. They may be changed, shortened, relocated, rescheduled, or canceled because of weather, safety needs, facility availability, enrollment, staffing, public health concerns, tournament needs, or other operational reasons.
These changes do not create a right to a refund, credit, makeup session, playing-time guarantee, or other compensation.
Payments, Donations, Refunds, And Credits
All registrations, fees, and donations are final unless Coronado Aquatics Club states otherwise in writing. No refunds are guaranteed for missed practices, missed events, participant withdrawal, illness, injury, disciplinary action, schedule changes, venue changes, coach substitutions, tournament non-selection, or event-format adjustments.
If any credit is ever offered, it is optional, non-cash, partial only, and provided solely at the discretion of Coronado Aquatics Club. Payments support the nonprofit organization and do not create membership, voting rights, ownership, or decision-making authority.
Use Of Funds And Donation Acknowledgment
Unless otherwise designated in writing by the donor and expressly accepted by Coronado Aquatics Club, donations are considered unrestricted and may be used to support any lawful activity consistent with the organization’s mission, at the discretion of its board of directors.
Donors who contribute $250 or more will receive a written acknowledgment from Coronado Aquatics Club in accordance with IRS Publication 1771. Donors are responsible for retaining tax records and should consult their own tax advisor regarding deductibility.
Medical Authorization And Participant Responsibility
A parent or legal guardian must complete registration for minors and provide current emergency and medical information when requested. By participating, you authorize coaches, staff, volunteers, emergency responders, and medical professionals to provide or arrange first aid and emergency care if reasonably necessary.
You accept full financial responsibility for any medical care, transport, medication, or treatment provided in connection with participation. You are responsible for ensuring that the participant is physically able to take part and for informing the Club of any condition that could affect safe participation.
Minor Participation And Parent Consent
Participants under 18 may take part only with parent or guardian permission. The registering adult accepts responsibility for the participant’s conduct, transportation, health disclosures, emergency contacts, and compliance with instructions, safety rules, and event procedures.
Tournament, Roster, And Playing-Time Discretion
Payment for a team, practice block, clinic, camp, or event does not guarantee placement in a particular roster, bracket, heat, game, travel opportunity, or amount of playing time. Selection, roster spots, lineup decisions, roles, and participation status are determined by the coaching staff based on safety, conduct, availability, payment status, athlete readiness, and program needs.
Privacy, Communications, And Cookies
Coronado Aquatics Club may collect the information you submit through this site, including parent and athlete names, email addresses, phone numbers, emergency contacts, registration details, and payment-related transaction information supplied through third-party processors such as Stripe.
This information may be used to process registrations and donations, send receipts, deliver schedule updates, respond to questions, support participant safety, improve website performance, and send program-related communications by email, text, or other digital methods.
Coronado Aquatics Club does not sell personal information. Information may be shared with service providers or partners who help operate the website, communications, payment processing, event logistics, or participant safety. This site may use cookies or analytics tools to support core site functions and improve the user experience. You may opt out of non-essential communications, but transactional and safety-related communications may still be sent when necessary.
Media Release
By participating in any Coronado Aquatics Club activity, you grant permission for photographs, video, audio, and other media depicting you or your child to be captured and used for program, promotional, educational, fundraising, and event-related purposes without compensation, unless you notify the Club in writing before participation and the Club expressly agrees to a limitation.
Liability Release
To the fullest extent permitted by law, you agree to release, waive, and hold harmless Coronado Aquatics Club, Nado Polo, Jesse Smith, coaches, staff, volunteers, facility operators, event partners, sponsors, and related entities from claims, demands, liabilities, losses, damages, or expenses arising out of or related to website use, registration, attendance, travel, participation, or emergency care connected to any Club activity.
California Civil Code Section 1542 notice: A general release does not extend to claims that the releasing party does not know or suspect to exist in their favor at the time of executing the release and that, if known, would have materially affected their settlement with the released party. By agreeing to these terms, you expressly waive the protections of this section.
Nothing in these terms limits rights that cannot be waived under applicable law, but all permitted releases, waivers, and limitations of liability are intended to be enforced as broadly as allowed.
Right To Refuse Service
Coronado Aquatics Club may refuse registration, deny service, remove a participant, or end participation at its discretion and within applicable law for safety reasons, rule violations, misconduct, incomplete or inaccurate registration information, nonpayment, or behavior that may disrupt the program or place others at risk.

Force Majeure
Coronado Aquatics Club is not liable for delays, modifications, interruptions, or cancellations caused by circumstances beyond its reasonable control, including weather, natural disasters, public health events, facility closures, staffing shortages, utility failures, government action, travel disruptions, labor issues, or other force majeure events.
Governing Law And Dispute Resolution
These terms are governed by California law. Any dispute arising from the website, registration, donation, or participation must first be submitted in writing to Coronado Aquatics Club so the parties can attempt informal resolution.
If a dispute is not resolved informally, the parties agree to pursue mediation before filing suit, and if mediation does not resolve the matter, to the fullest extent permitted by law the dispute will be resolved by binding arbitration in San Diego County, California. Court proceedings may be used only when required by law or to enforce an arbitration award or other provisional remedy.

By using this site, registering, donating, purchasing, or participating in any Coronado Aquatics Club activity, you confirm that you have read and understood these terms, voluntarily accept the risks described above, agree to be legally bound by them, and, if registering for a minor, agree on behalf of that participant as well.
