Use Of Funds
Unless otherwise designated in writing by the donor and expressly accepted by Coronado Aquatics Club, all donations are considered unrestricted and may be used to support any lawful activity consistent with the organization’s mission, at the discretion of its board of directors.
IRS Donation Acknowledgment
Donors who contribute $250 or more will receive a written acknowledgment from Coronado Aquatics Club in accordance with IRS Publication 1771. It is the donor’s responsibility to retain this documentation for tax reporting purposes.
Donations And Non-Membership Status
All payments made to Coronado Aquatics Club, including registrations, sponsorships, event tickets, and general contributions, are treated as donations and do not confer membership, voting rights, ownership, or decision-making authority within the organization.
Participation in events or receipt of any related service is not guaranteed. Donations are not purchases. The estimated fair market value of any incidental benefit, including event participation, is $0.01 or the lowest value permitted by law.
No Refunds Policy
All donations, registrations, and payments are non-refundable, including cancellations by participants, no-shows, and changes to event format or details.
Event Structure And Services
Each event, including triathlons, may provide different services, schedules, or experiences for different age groups. Coronado Aquatics Club reserves the right to change event dates, times, and locations, modify formats or age-group structures, and cancel or adjust events due to weather, water quality, safety, or public health concerns.
Triathlon Participation Waiver
The Polar Bear Triathlon is a beach-based endurance event and may include beach running, ocean racing, and other physical challenges. Biking is not guaranteed and may be excluded depending on age group or logistics.
Distances and formats vary by age group. Adults may complete an approximately 250-yard ocean out-and-back swim, while young children may participate in shorter wave-based races.
Eligibility And Risk Acknowledgment
Participation in older age groups requires strong swimming ability, ocean safety awareness, physical fitness, and comfort in cold water conditions.
Participants understand and assume all risks associated with ocean and beach-based physical activity. Cold ocean water increases physical difficulty and can pose additional health and safety challenges. A signed medical release and liability waiver are required prior to participation.
Force Majeure
Coronado Aquatics Club shall not be held liable for any delay, modification, or cancellation of services or events due to circumstances beyond its reasonable control, including natural disasters, acts of God, government restrictions, public health emergencies, or venue and staffing issues.
Limitation Of Liability And Waiver
By registering, donating, or participating in any Coronado Aquatics Club event, you agree to release and hold harmless Coronado Aquatics Club, its staff, volunteers, and affiliates from any and all claims, liabilities, or damages.
California Civil Code Section 1542 notice: A general release does not extend to claims that the releasing party does not know or suspect to exist in their favor at the time of executing the release and that, if known, would have materially affected their settlement with the released party. By agreeing to these terms, you expressly waive the protections of this section.
Minor Participation And Parental Consent
Participants under 18 must have a parent or legal guardian complete registration on their behalf, acknowledge the terms and risks above, and accept full responsibility for the child’s participation.
Media Release
By participating in any Coronado Aquatics Club event, you grant permission for photos, video, and other media including your or your child’s likeness to be used for promotional, educational, and event-related purposes without expectation of compensation.
Right To Refuse Service
Coronado Aquatics Club reserves the right to refuse service or participation to any individual or entity, in its sole discretion, within the bounds of applicable law.

Governing Law And Dispute Resolution
These terms are governed by the laws of the State of California. Any disputes will be resolved via binding arbitration or in the courts of San Diego County, California.
Acknowledgment
By registering, donating, or participating in any Coronado Aquatics Club activity, you confirm that you have read and understood these terms, agree to be bound by them in full, and accept all related risks and conditions.
